Townhouse properties follow the generally applicable Charleston Place covenants plus the additional townhouse provisions that cover their property. Those townhouse-specific requirements do not automatically apply to ordinary detached homes.
Article XV §6(A) says the other Declaration restrictions also apply alongside the townhouse provisions. The November 1996 and 1998 amendments must be read together to identify the affected land, dwelling type and Association authority.
| Topic | Detached homes | Townhouse properties |
|---|---|---|
| Community covenants | Follow the Declaration and amendments applicable to the lot. | Follow the generally applicable provisions plus the additional townhouse provisions applicable to the property. |
| Article XV | Townhouse-specific provisions do not apply merely because the home is in Charleston Place. | Applies within its defined scope, as affected by the recorded amendments. |
| Maintenance and exterior work | Review applicable Article VII architectural requirements, Article VIII maintenance obligations and amendments. | Article XV §5(B) adds an approval requirement for repairs, redecorations, painting and maintenance, alongside other applicable provisions. |
| Party walls and common areas | Do not assume the townhouse arrangements cover the property; check its own governing record. | Additional party-wall, common-area and easement arrangements may apply under Article XV and later amendments. |
| Budgets and assessments | The reviewed Bylaws allocate subdivision-wide expenses to all lot owners. They do not allocate the additional Townhouse Budget to ordinary detached-home owners. | Article XI of the reviewed Bylaws states that townhouse owners contribute to the Subdivision Budget and an additional Townhouse Budget. Read these provisions with the 1998 amendment and any later valid changes. |
| Townhouse board elections | Do not assume detached-home owners may elect the separate Townhouse Association board. | The 1998 amendment requires a separate board made up of townhouse owners and limits voting for that board to townhouse owners. This does not itself resolve voting in the broader Property Owners Association. |
| Association authority | A requirement must be supported by authority applicable to the property. | The separate Townhouse Association has the authority given to it by the applicable documents; that authority does not automatically extend to every Charleston Place lot. |
Important distinction: This comparison separates detached homes from townhouse properties. A townhouse can itself be a single-family dwelling. Some provisions in the same amendment use broader language, so do not treat the entire 1996 or 1998 amendment as townhouse-only.
Exact townhouse scope: The 1998 amendment extends Article XV to the identified Lots 1–13 and Tract D upon which a townhouse is constructed. Its separate Townhouse Association powers clause addresses real estate where a townhouse is built or may be built. Those are distinct scope provisions; check the property’s plat and governing record.
Bylaws are a separate document: The Bylaws linked here are those of the Property Owners Association. Do not assume this copy is also the separate Townhouse Association’s complete corporate bylaws; obtain that Association’s own records when needed.
Before applying a requirement: Identify the specific clause, the land it covers, the applicable amendment and the Association authorized to act. A townhouse rule is not automatically a restriction on all detached homes.
What’s included: The available 1994 Declaration, Property Owners Association Bylaws, three 1996 amendments, the 1998 amendment, the 2023 Tract E adoption, and the 2024 and 2025 amendments with their 2026 rescission.
This is a review of the available copies, not confirmation that no other recorded instruments or later corporate amendments exist. Property-specific records and later valid changes may affect the result. The Bylaws state that the Declaration controls if they conflict.
