Homeowner FAQ

Find a quick answer, choose a topic, and open a question to read more.

Welcome, neighbors. These short summaries help you find your way around the documents, projects and community procedures. Read the linked sources for full details. For official decisions or your individual situation, contact the Association.

Documents

Where can I find the community documents?

Visit the Documents page for the Declaration, Bylaws, amendments and historical records. Open a PDF to read or save it. Read its status label before relying on it.

What is the difference between the Declaration and Bylaws?

The Declaration sets out property restrictions and Association responsibilities. The Bylaws explain how meetings, director elections, officers and other Association procedures work. Read applicable amendments with both.

Why are some documents marked historical or rescinded?

They preserve the document history. A rescinded document is kept for reference, rather than presented as a current requirement. The Documents page links the available recordings and status information.

How do I find a word inside a PDF?

Open the PDF and use its search tool, or press Ctrl+F on Windows or Command+F on Mac. Scanned pages may not contain searchable text. Website search does not search inside every PDF.

How do I request other Association records?

Send the Association a written request identifying the records and date range you need. Keep a copy. This independent website may not hold every Association record.

Home Improvements

Where should I start with an exterior project?

Review the Documents and confirm the ACC’s submission process before work begins. Fences, additions and outdoor structures are examples of projects that may need review.

The ACC submission form requires sign-in. Confirm with the Association that this is its accepted submission channel; the website itself does not grant approval.

What should I include with my plans?

Include your name, property address, contact details and a short project description. Add the location, dimensions, materials, photos or drawings, and expected schedule. Ask the ACC whether it needs anything else.

How do I follow up or change my plans?

Include your property address, project name and original submission date when following up. Keep your plans, replies and any written decision together. Send material changes to the ACC before carrying them out.

Townhouse Requirements

Do townhouses have extra requirements?

Yes. In addition to generally applicable covenants, specified townhouse properties have provisions about party walls, shared areas, easements and maintenance approvals. These townhouse-specific provisions do not automatically apply to every detached home.

Does the townhouse maintenance clause apply to detached homes?

Not automatically. Article XV has a defined townhouse scope. Detached homes still follow the architectural-review and maintenance requirements that apply to their property. Check the specific provision and project.

Can the Townhouse Association make rules for every lot?

A requirement must have a basis in the governing documents and apply to the property involved. Ask which Association is acting and which provision authorizes the requirement. Townhouse-specific authority is not automatically subdivision-wide.

Meetings, Elections & Officers

Where can I find meeting dates and proxy instructions?

Check the Association’s current meeting notice and meeting page for available information. Ask the Association for the current proxy form and submission instructions. This FAQ does not publish a verified upcoming meeting date or proxy form.

The Bylaws allow written proxies filed with the Secretary. The Meeting Guide explains how to prepare.

Do homeowners elect directors each year?

The Bylaws provide for three directors with one-year terms and an annual election process. Their text distinguishes the developer-control period. Any claimed exception or later change should be supported by the governing documents.

What are the basic election steps?
  1. Send the required meeting notice; the Bylaws call for mailed notice at least 15 days in advance.
  2. Check eligible votes, written proxies and quorum.
  3. Accept nominations, including nominations from the floor.
  4. Use secret written ballots. Cumulative voting is not allowed.
  5. Count the ballots, announce the results and record them in the minutes.

See Open questions we’re checking for the election-threshold wording that needs clarification.

Can the election be skipped if there are no new candidates?

The Bylaws do not provide a “no new candidates” exception. Willing incumbents can stand again, and floor nominations are allowed. If nobody is willing to stand or no successor is elected, record what happened and arrange the next steps.

Does a missed election automatically remove the directors?

No. The Bylaws provide for continued service until a successor is elected and qualified. Continuing in office is different from being reelected; it does not replace the election process.

What is a quorum?

A quorum is the voting power needed to conduct business. The Bylaws generally require one-fifth of the votes, represented in person or by proxy, unless another governing provision applies. Count votes, not just people.

For example, 100 eligible votes would require 20 represented votes under that rule. This is an example, not the Association’s current total. Without quorum, the Bylaws provide for adjournment.

Can I inspect the meeting voting list?

Missouri’s nonprofit statute provides meeting-related inspection rights for members, including written-demand procedures. The list identifies eligible members, addresses and vote allocations. It must also be available at the meeting; it is not a public website directory.

Who chooses the President, Vice President, Secretary and Treasurer?

Homeowners elect directors; the Board elects officers. The Bylaws call for annual officer selection at the first Board meeting following the annual member meeting. President and Vice President must be directors.

The Secretary and Treasurer positions may be combined. Other combinations are restricted by Article VIII §7.

What happens when someone resigns?

Director and officer positions are separate. Resigning as President does not necessarily mean leaving the Board. The remaining directors fill a director vacancy for the predecessor’s remaining term; the Board fills an officer vacancy for the remainder of that officer’s term.

Is the Townhouse Association board elected separately?

Yes. Amendment 7 of the instrument commonly called the 1998 amendment describes a separate townhouse board elected by townhouse owners. Keep that election distinct from the broader Property Owners Association election.

Open Questions We’re Checking

Which current voting details still need confirmation?

The published documents explain the framework. These current details need supporting Association records:

  • The eligible voting list, votes per lot and total voting power used for quorum.
  • Any developer voting or appointment rights currently claimed, with the provisions and ownership records supporting them.
  • How Article IV’s majority wording will be applied alongside Article V’s largest-number-of-votes wording.
  • The seats, proxy instructions, ballot-counting arrangements and handling of ties for the next election.

We will update this section when supporting information is available. The website has not confirmed a current developer vote total or resolved the election-threshold question.
